Well, they are right - the laws are archaic. My argument is that Opinions (the Judge's written decision after deciding a case) are handed down daily from multiple jurisdictions dealing with the breadth and scope of the Wire Act, and how it applies to modern circumstances and situations. So, while the legislators say that the law is archaic, they fail to mention that this OLD law is easily applied to everday, modern cases. It's a red herring.

While laws can "read" scary, you have to consider how they're going to enforce those laws. Consider the "cigarette" ban many states are enacting, where you're not allowed to smoke indoors at public places. This law is quite easy to enforce because it's *easy* to fine a bar allowing smokers. Once you start fining bars and clubs, they enforce the rules.

It's important to consider how a law can be enforced before considering its ramifications. If enforcing a law is impractical there's a solid chance it just won't pass. I wonder how they are going to enforce an "internet gambling" law? They certainly can fine credit card companies if they allow a deposit to an "internet gambling" website. (WOW - that's alot of records to go though! Do we need to increase taxes to pay for the new government entity we need to form to handle this work?)

The problem - for the government - is dealing w/ the three-way transactions. (Ie: Bank Account > Paypal / Neteller > Website). Would sites such as PayPal / Neteller / etc. full under the gambit of "gambling websites?" Not at all! If the government disallowed the transfer from my bank account to my Neteller account, I have an EASY 1st Amendment argument that the new law is unconstitutional because it's over-encompassing.

I smoke deal with it.
Fundamental Laws were not made to protect an individual group but to PROTECT THE RIGHTS OF EVERYONE.
Which means no law to hurt smokers and no law to help them either.
Fat people don't need a law to protect them from buying 2 tickets at the airport they need to buy the extra seat and shut up.
Skinny ppl don't need a law to protect them from sitting next to the fat stinky guy on the plane. It's just crap luck Next time I'll get him.

If my smoke bothers you ask me to put it out and I will but the USA does not need a law to enforce it.
There are too many laws on the book.

Finally, the anti-smoking laws wouldn't have passed if they weren't favored by the majority. That's how gubment works.


Washington State is a HUGE DEMOCRAT STATE

In the previous election the our female gov. won by hundreds of thousands of votes. Then in her reelection she proposed the smoking ban. RESULT she LOSES THE ELECTION pulls a george bush in a recount and wins.

the point that she won does not matter it's the fact that HUNDREDS OF THOUSANDS OF PPL CHANGED THEIR VOTE not just smokers NON SMOKERS who know that Washington has no state tax and the reduced # of cig's sold because of the ban will decrease tax revenue 10 fold and lead to higher taxes elsewhere.

And for you whiners about second hand smoke if your sitting in a bar 8 hours a day worried about the second hand smoke odds are the whiskey and beer will destroy you LIVER LONG LONG LONG LONG before the smoke will ruin your soprano voice. Have a nice day.

Of course! That's it! By banning cigs in public places people will buy less smokes! Damn, why didn't anyone else think of this. The gov't should ban cocaine, speed, LSD, and pot too! Just think, if it's banned, no one will buy it...

I don't know ONE SINGLE PERSON that cut back on smoking when we enacted a public smoking ban here in London. That has to be the single-most absurd thing I've read in this thread (and that's saying a lot!)

Give me some #s that show any smoking ban in public places has decreased cigarette sales significantly. If anything, it hurts alcohol sales in Florida, because half the bar is outside smoking!

I don't think anybody here is sitting in a bar 8 hours a day (except Geoff). A bar isn't the only place people smoke either.

If you had a device that you carried around, like a proton pack from Ghostbusters, and it emited a poisonous gas, do you think you'd be allowed to carry it around in public? The smoke causes health problems. You should have no right to smoke in the presence of others who choose not to be infected by it.

I smoked a cigarette yesterday.
